Introduction

The UK government announced new steps to safeguard women’s and girls’ rights and hold online platforms more responsible in a press release. According to the law, websites must take down offensive, private photos within 48 hours.

These regulations indicate a stricter examination of the data shared online, as the social media sites where we interact are exposed to privacy violations. In this digital era, it takes just a few seconds to share private images across different online platforms

The UK government is redefining the operational responsibilities through a 48-hour deadline. The development highlights a systematic shift to a tighter platform accountability in the digital era.

Policy Framework

The amendment was done in the Crime and Policing Bill, which requires companies to remove any explicit content within 48 hours after the complaint is launched. If the platforms fail to comply, it could trigger penalties of up to 10% of global revenue, as well as service blocking in the United Kingdom.

In a press release, it was explained that it is a one-time process, which means the victim has to report the image once, after which it will be prevented from being reposted again.

The United Kingdom’s communication regulator, Ofcom, will oversee the compliance of digital platforms with the amendments to legal standards.

Institutional & Legal Context

The Online Safety Act will include the proposed amendments, through which it is clarified that sharing explicit pictures constitutes a “priority offense,” and places them on the same level of seriousness as child abuse or terrorism.

“It is an essential step that we are taking in the online world to keep it safer and respectful towards women and girls,” said Alexa Davies-Jones, Minister of Violence Against Women and Girls.

She emphasized that because offensive information has a terrible effect on people’s lives, it must be taken down as soon as a complaint is made about it.

The policy modifications will also provide regulatory guidance to internet providers on how to restrict access to websites that house such content.

Impact on Tech Platforms 

Digital platforms will have to address the additional responsibilities related to governance and compliance issues. The companies have to update their reporting criteria, hiring and training of reporting staff, and integration of AI with the upgraded systems.

However, this may increase the operational cost, but risk assessment of internal and external processes will help companies to prevent themselves from fines and enforcement actions.

Digital Rights & Safety Perspective 

Activists for online safety rights emphasize the importance of a right balance between rapid content removal and procedural fairness. To avoid abuse or excessive removal, platforms should guarantee decisions based on facts and offer appeal procedures, carefully balancing freedom of expression, privacy, and safety.

The time-sensitive removals provide the complainant with control over the reporting process. Moreover, it helps with emotional distress, social standing, and prolonged mental health damage to the affected individual.

In Pakistan, legislation such as the Prevention of Electronic Crimes Act 2016, widely known as PECA, focuses on online harassment, cyberstalking and the circulation of nonconsensual images. However, there are serious issues related to the compliance procedure and mandated response time to remove the explicit content.
